General Terms and Conditions and Customer Information
1. Scope
These general terms and conditions (GTC) govern all contracts concluded via the website www.privatoys.com between Challenge Business Consult GmbH (hereinafter referred to as “provider”) and the users of this website (hereinafter referred to as “customer”). These GTC apply to all orders and business relationships unless different individual agreements have been made. Different terms and conditions of the customer do not apply unless the provider has expressly agreed to their validity in writing.
2. Subject of the contract
The provider offers various hygiene products via the website www.privatoys.com. The specific product description can be found on the respective product pages of the website. The provider reserves the right to change or expand the range at any time.
3. Conclusion of contract
(1) The presentation of the products in the online shop does not constitute a legally binding offer, but a non-binding invitation to the customer to place an order.
(2) By submitting the order by clicking on the “Buy” button, the customer makes a binding offer to conclude a purchase contract for the products in the shopping cart.
(3) The provider can accept this offer by an express declaration of acceptance by email or by shipping the goods. Receipt of the order is automatically confirmed by email immediately after submission, but does not constitute acceptance of the contract.
(4) If a product is not available, the customer will be informed of this and any payment already made will be refunded immediately.
4. Prices and payment conditions
(1) All prices stated are total prices in the respective currency and include VAT, unless otherwise stated.
(2) Additional shipping costs or fees are expressly stated on the website.
(3) The provider accepts various payment methods that the customer can choose from on the payment page. Available payment methods may include advance payment, credit card, PayPal or other electronic payment methods.
(4) Payment is due immediately after conclusion of the contract, unless a different payment period has been expressly agreed.
5. Delivery and shipping
(1) Delivery is made to the delivery address provided by the customer.
(2) If a delivery cannot be made for reasons for which the customer is responsible (e.g. incorrect address details), the customer will bear the additional shipping costs for a re-delivery.
(3) Shipping is carried out directly by the manufacturer or supplier to the customer. The provider assumes no responsibility for delays or defects caused by the third-party provider.
(4) Shipping costs may vary depending on the supplier and are displayed to the customer accordingly during the ordering process.
6. Warranty and liability
(1) The statutory warranty rights apply.
(2) The provider is only liable for damages caused by intentional or grossly negligent breaches of duty. The provider is only liable for simple negligence if essential contractual obligations (cardinal obligations) are violated and is limited to foreseeable damage.
(3) Any further liability, in particular for indirect damages, consequential damages or lost profits, is excluded to the extent permitted by law.
(4) Liability for damages resulting from injury to life, body or health remains unaffected.
7. Data protection

8. Final provisions
(1) Should individual provisions of these terms and conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
(2) The law of the country in which the provider is domiciled shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.
(3) To the extent permitted by law, the exclusive place of jurisdiction for all disputes arising from or in connection with these terms and conditions shall be the provider’s domicile.
